Terms of sale

Sparkbreaker is made and sold by Harness the Spark Ltd ("we", "us"). By buying or using Sparkbreaker you agree to these terms. If you do not agree, please do not buy or use it. You must be at least 18, or otherwise able to enter into a contract.

Your statutory rights are not affected by these terms. If anything here conflicts with your statutory rights, your statutory rights win.

What you are buying

A licence to use the Sparkbreaker app on your own Mac, for a one-off price. The licence is personal to you, non-exclusive and non-transferable. It lasts for as long as you use the version you have, unless you breach these terms.

What you may not do

• Share, resell or give the app to other people.
• Reverse engineer, decompile or try to extract the source code.
• Use the app for anything unlawful or harmful.
• Use our name or branding without our written permission.

What the app does and does not do

Sparkbreaker closes AI apps, blocks AI sites on your Mac and keeps a local record of your sessions. The record is protected by a hash chain, which makes it tamper-evident, not tamper-proof. It is a helpful log, not legal proof of anything.

The app supports your own confidentiality practice. It does not replace your professional, legal or ethical duties, and you remain responsible for how you handle client information. Sparkbreaker keeps everything on your Mac. We cannot see your records and cannot recover them.

Your passcode is also stored only on your Mac. If you forget it, the only way back in is a full reset, which wipes your set-up and session records.

Ownership

You own your set-up and records. We own the app, including its software, design and branding.

Warranties and liability

We take care over the app, but it is provided "as is" and we cannot promise it will be free of faults or will work with every setup. To the extent the law allows, we are not responsible for loss of profits, data or business opportunities, or for indirect losses. Our total liability to you will not be more than the amount you paid for the app.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Using this website

sparkbreaker.com is run by Harness the Spark Ltd. Its text, images, design and software belong to us or are used with permission, and are protected by copyright and other intellectual property laws. You may view the site and share its address, but please do not copy it or pass it off as your own.

Please do not use the website to break the law, to harass or deceive anyone, to upload anything harmful, to scrape or overload it, or to get around its security. We may block access if you do.

We work to keep the website accurate and available, but it is provided "as is" and we cannot promise it will always be error-free or online. To the extent the law allows, we are not liable for loss arising from using the website. Emails you send us are handled as set out in our privacy policy.

Ending the licence

We may end your licence if you seriously breach these terms. If we end it for any other reason, we will refund what you paid.

Changes

We may update these terms. The version on this page when you pay is the one that applies to your purchase.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live elsewhere in the UK, you keep the right to use your local courts.
